Scheduling of private/in-house training lessons
- The initial timetable for tuition will be arranged between the Course Coordinator for Vivere l’italiano Ltd (“the School”) and the client student.
- Any subsequent variations to this timetable may be agreed directly between the tutor and the student.
- An agreed number of lessons/hours must be confirmed before lessons commence; this constitutes a “block” of lessons.
- Safety note: If tuition takes place at the student’s home, the student may request a prior meeting or that the first lesson be conducted in a public place suitable for learning. This is at the tutor’s discretion.
Fees & Payment
- Payment for the agreed block of lessons must be made in full (cleared funds) at least 72 hours prior to the start of lessons.
- Subsequent blocks may be arranged once the current block is completed or nearly completed.
- Unless otherwise agreed:
- Face-to-face lessons: minimum 1.5 hours
- Online lessons: minimum hour
Travel charges:
- Lessons in London Zones 1 & 2: as per the current rate confirmed by the School.
- Difficult-to-reach locations in or outside Zones 1 & 2 and during peak hours: rates quoted individually
- Tutors may travel by public transport; notify the School for remote location arrangements.
- Online lessons are not subject to travel fees.
Block minimum:
- To secure the agreed tutor, a block of at least 9 hours should be booked.
- Lesson-by-lesson bookings may result in a different tutor being assigned if the original tutor is unavailable.
Validity of tuition fees
- Tuition fees paid must be used within 6 months from the date of payment.
- After 6 months, fees expire and are non-refundable.
Refunds
- Refunds are at the School’s discretion.
- An administration charge of 50% of any unused balance applies to cover time arranging tuition, liaising with students, and other expenses.
- Any card or payment processing fees are deducted from the refund.
- Discounts based on block size will be recalculated if a partial refund affects the number of lessons completed.
Example:
- Standard rate: £42/hour, discounted to £40/hour for blocks over 15 hours
- 20-hour block booked: £800 paid
- 10 hours completed; refund requested for 10 hours
- Calculation: 10 hours × £42 = £420; refund = £800 − £420 − 50% admin charge on unused hours = £380
Cancellations by the student
- Less than 24 hours’ notice: chargeable as if the lesson occurred (“Late Cancellation”).
- More than 24 hours’ notice: not chargeable.
- Maximum late cancellation charge: 2 hours per lesson, regardless of scheduled duration.
Rescheduling & Tutor Absence
- Cancelled lessons will be rescheduled where possible.
- If a tutor must cancel, students are notified promptly. Cancelled lessons by the tutor are not chargeable.
- If a tutor is absent for an extended period, a replacement tutor may be provided.
Non-Circumvention / Non-Solicitation
- Obligation: The Client agrees that during tuition and for 12 months following the last lesson, they shall not, directly or indirectly, engage, employ, or otherwise contract with any tutor introduced by the School outside the School’s services without prior written consent.
- Scope: This restriction applies to:
o Any immediate family member of the Client
o Any company, partnership, or organisation controlled or owned by the Client
o Any third party to whom the Client has introduced the tutor
- Liquidated Damages: In the event of breach, the Client agrees to pay £2,500 per tutor and/or introduced third party, representing a genuine pre-estimate of the School’s loss, including recruitment costs, administrative expenses, and loss of anticipated revenue. This is not a penalty.
- Acknowledgement: The Client acknowledges this clause is reasonable, proportionate, and necessary to protect the School’s legitimate business interests.
- Enforcement: The School reserves the right to recover any fees or damages payable under this clause through legal proceedings if necessary.
Tutors’ Contracts
- Tutors engaged by the School agree not to provide tuition independently to any client introduced by the School, or any individual/company for whom they have provided tuition, during engagement and for 12 months after termination.
- Any breach allows the School to recover fees paid directly to the tutor without deduction.
- Students are asked not to approach tutors for independent tuition to avoid compromising this agreement.
Communication with Tutors
- The platform allows messages to/from tutors for lesson-related matters.
- Exchange of personal contact details between students and tutors is discouraged.
- WhatsApp groups may be created by the School for urgent, time-sensitive communication only. This group is not for private communication with the tutor.
- Direct private contact with tutors via WhatsApp, email, phone, social media, or other channels outside the School’s platform is a breach of contract and may trigger £2,500 liquidated damages per tutor and/or introduced third party.
Variations to these Terms and Conditions
- The School reserves the right to vary these Terms & Conditions at any time.
- Any variation will be communicated to students in advance.
